Your Privacy is important to Gizmo5 Technologies, Inc. (hereinafter altogether Gizmo5). Therefore, Gizmo5 is committed to respecting your privacy and the confidentiality of your personal data and traffic data. This Privacy Policy is designed to assist you in understanding how Gizmo5 uses and safeguards the information, personal data and traffic data you provide in using Gizmo5's internet phone software (hereinafter Software) and the Service (hereinafter Service).

Explanation of Service.

Through the website www.GizmoProject.com (hereinafter Website), Gizmo5 offers the Software as well as Service (services of Gizmo5 for which you need to make a payment, i.e. the service which allows you to make calls to and receive calls from end-users on the Public Switched Telephone Network (hereinafter PSTN)).

Installing the Software allows you to communicate with any other Gizmo5 user through voice communication and/or other forms of communication, through the Internet. By making use of the Service, you are also able to make communications to end-users on the PSTN.

This Privacy Policy for Paid Services exists in conjunction with the Privacy Policy published on www.GizmoProject.com that refers to the use of the Gizmo5 Software.

Service

In order to provide you with the Service, Gizmo5 shall collect and process the following personal and traffic data.

Subscriber information

In order to verify your identity and to provide the Service, Gizmo5 asks you to enter some personal data including, but not limited to, your name, billing information and e-mail address, on the Website. We use a third party billing provider to bill you for the Services and we will, therefore, provide this billing provider with the necessary billing data.

This subscriber information is securely stored on a server of Gizmo5 or Gizmo5's third party billing provider and is used by Gizmo5, as well as by the third party billing provider, in accordance with the relevant legislation.

Please note that your billing data are sensitive pieces of information, which can be used to find out information about your use of the Services. Please be sure to keep this information safe and do not share it with others.

Traffic Data

In order to transmit the calls through the PSTN and to bill the calls, Gizmo5 collects traffic data. Traffic data means any data processed for the purpose of the conveyance of communication or the billing thereof, including, but not limited to, the duration of a call and the (IP) numbers of the called party and the calling party.

How Gizmo5 uses personal and traffic data and the confidential communication

Gizmo5 shall take appropriate organizational and technical measures to protect the personal and traffic data provided to it or collected by it. Your personal and traffic data can only be accessed by authorized employees of Gizmo5 who need to have access to these data in order to be able to fulfill their given duties.

Gizmo5 shall not sell, rent, trade or otherwise transfer any personal and/or traffic data to any third party other than our trusted partners without your explicit permission. However, Gizmo5 may sometimes share your personal and traffic data with carriers and/or agents in order to provide you with the Service or other services you have requested; for example the PSTN-VoIP gateway provider and/or the third party billing provider. Gizmo5 will always require these third parties to take appropriate organizational and technical measures to protect your personal and traffic data and to observe the relevant legislation.

Delete/Deactivation Policy

If you wish to delete any personal Information you submitted to Gizmo5 Technologies, Inc, you may do so by contacting us at delete@gizmo5.com. We will notify you of our receipt of your request. We will use commercially reasonable efforts to functionally delete all such information (excluding any information necessary in order to detect fraudulent use) from our database within fifteen working days from the date of the receipt of your request. Please note that it may be impossible to delete a user.s entry without some residual Information because of backups and records of deletions. Gizmo5 reserves the right not to delete information in order to comply with applicable local laws or regulations.

Use From Outside the United States

If you are visiting this website or using Gizmo5 from outside of the United States, please be advised that your information will be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws the United States and other countries, might not be as comprehensive as those in your country. Please be assured that we seek to take reasonable steps to ensure that your privacy is protected. By using our software and services, you consent to the transfer of your information to our facilities and those third parties with whom we share it as described in this Privacy Policy.

Modification of Privacy Policy.

Gizmo5 reserves the right to modify the provisions of this Privacy Policy if deemed necessary. We will inform you of these changes on our website. You agree that by continuing to use the Gizmo5 Software or Services following the publishing of the revised Privacy Policy indicates your acceptance of this Privacy Policy.
