E-commerce Policies
This document refers to premium services purchased from the Gizmo5.com members area (Site
) or from the Gizmo5 Software (Software
). Accessories sold by third parties to enhance your computer for VoIP such as headsets and speakerphones are covered by the terms and conditions of the relevant site or service. This includes third party sites linked from the Gizmo5 site.
Return Policy
It may take up to 12 hours to credit your Gizmo5 account.
To make sure you will be satisfied with any product you purchase, you should extensively test your Gizmo5 account before making a purchase. Refunds are available if requested within 24 hours of being activated. All refunds are subject to a $2.00 processing fee, and must be requested within 24 hours of crediting.
Requests for refunds should be made from the support site, where you can submit a trouble ticket to request a refund. Processing refunds on Call Out credit can take up to 15 business days. You will receive an email notification when your credit is successfully processed. Call Out credit expires 365 days after purchase.
Troubles Making Purchases
Fraud is a reality with e-commerce of virtual goods (things not delivered to a physical address). While the majority of the fraudulent transactions are successfully stopped by numberous filters used on each transaction, a small percent of good
customers are incorrectly rejected.
To avoid triggering a fraud filter, enter in all your billing information EXACTLY as it appears on your statement. If you are still having trouble, we have provided you alternate ways to make purchases with our service.
Call Out Expiration Policy
Unused Call Out credit, purchased from Gizmo5, will expire 1 year from time of purchase. Credit can be redeemed if another purchase is made within that timeframe. For more information view Frequently Asked Questions on this topic.
Moneybookers
Gizmo5 accepts payments from users with Moneybooker accounts. Please be aware of fees, if any, charged by Moneybooker to transfer funds. Transactions from suspicious Moneybooker accounts will be reversed and the account blocked from future purchases.
Money Orders/Cashier Checks
Gizmo5 does not accept money orders or cashier checks. To use a money order or cashier check, open Moneybookers account, which allow you to deposit money into an account and then make payments. Any Money Order/Cashier Check received in the mail will be returned to sender. We are not responsible for lost or destroyed mail.
Transaction Security
All e-commerce transactions are conducted via a secure, encrypted (https) connection. We use a 128-bit encryption, the standard for internet commerce and security.
Fraudulent Usage
If you believe your account or credit card have been fraudulently used in conjunction with our service, please submit a trouble ticket and we will investigate. We will send you an email with the findings of our investigation within one (1) week.
Credit/Debit Card Charge-Back Policy
You understand, acknowledge and agree that by initial and continued use of the services provided by us, you agree to, and are bound by the Credit/Debit Card Charge-Back Policy. You understand, acknowledge and agree that we may revise policies, agreements and notices at any time without notice and that you shall be bound by the policies, agreements and notices as currently posted on our web site which as a whole shall constitute Gizmo5.com's Acceptable Use And Service Agreement. It is our policy to report all forms of Credit/Debit Card fraud to the appropriate legal authorities, regardless of country of origin, and to vigorously prosecute individuals and/or companies that commit Credit/Debit Card fraud by means of charge-backs, use of fraudulent Credit/Debit Cards or other forms of Credit/Debit Card fraud. We consider the Credit/Debit Card charge-backs for services ordered and provided to be prima fascia evidence of 'Theft Of Service' as defined under Delaware Criminal Code Section 845.
You understand, acknowledge and agree we will apply and invoice for a charge-back processing fee of $50.00 (USD) to the account balance for each Credit/Debit Card 'charge-back' related to the services provided by us.
You understand, acknowledge and agree that unless payment in full, by Certified Check or Money Order, including both the original amount due plus charge-back fee, is received within ten (10) days of invoice a collections processing fee in the amount of $150.00 (USD) will be added to the account balance for each Credit/Debit Card 'charge-back' related to the services provided by us. You understand, acknowledge and agree that unless payment in full, by Certified Check or Money Order, including both the original amount due plus charge-back and collections fee, is received within ten (10) days of invoice, we may take legal action to collect the debt, including, but not limited to the filing of charges for Theft of Service amounting to more that $150.00 (USD), a felony, under Delaware Code Section 637:8. Payment under this provision shall not prevent us from seeking to obtain other legal remedies, both civil and criminal, including but not limited to, other expenses, damages, court costs, attorneys fee's and statutory interest.
Modifications
We may modify this policy at any time without providing notice to you. Such modification will be made by posting a revised policy on the Site and such modification shall be deemed effective immediately upon posting of the modified policy. Your continued access or use of the Software, our services or the Site shall be deemed your acceptance of the modified Policy. You agree to check the Site periodically to review such modifications.
